1. About TOWNWAY

TOWNWAY is an online marketplace that enables customers to discover and purchase products offered by participating sellers.

Products available on TOWNWAY may be offered by independent sellers registered on the TOWNWAY marketplace.

TOWNWAY may facilitate services including product discovery, order processing, payment processing, customer support and delivery coordination.

Where applicable, the seller responsible for an order may be identified through the product or order information provided to the customer.

2. Definitions

For these Terms:

Customer / User / You / Your means any person accessing or using TOWNWAY.

TOWNWAY / We / Us / Our means TOWNWAY, the operator of www.townway.in.

Seller / Vendor means an independent business or merchant offering products through the TOWNWAY marketplace.

Website means www.townway.in.

Services means the website, mobile applications, marketplace, ordering and related services provided through TOWNWAY.

Product means any item offered for sale through TOWNWAY.

3. Eligibility and Use of the Website

You agree to use TOWNWAY only for lawful purposes.

You must not:

• Violate applicable laws or regulations.
• Provide false or misleading information.
• Attempt unauthorized access to TOWNWAY systems.
• Interfere with the operation or security of the website.
• Use the platform for fraudulent transactions.
• Infringe the rights of TOWNWAY, sellers, customers or third parties.

You are responsible for providing accurate information and maintaining the confidentiality of your account credentials.

You should immediately notify TOWNWAY if you believe your account has been accessed without authorization.

5. Marketplace and Sellers

TOWNWAY provides a marketplace through which participating sellers can offer products to customers.

Sellers are responsible for ensuring that information submitted regarding their products, including descriptions, specifications, prices, availability and applicable product information, is accurate.

TOWNWAY may review, modify, restrict or remove listings that violate marketplace policies, applicable laws or customer-protection requirements.

TOWNWAY does not permit sellers to intentionally provide misleading product information or offer counterfeit, prohibited or unlawful products.

6. Product Information

We and our sellers make reasonable efforts to display accurate product descriptions, images, specifications, pricing and availability.

Actual product colours or appearance may vary slightly depending on photography, lighting, screen settings, packaging updates or manufacturer changes.

Material differences affecting the product will be handled in accordance with the applicable Return, Refund and Cancellation Policy.

7. Pricing

Product prices are displayed in Indian Rupees (INR) unless otherwise stated.

The price applicable to an order will be shown before the customer confirms the purchase.

Applicable taxes, delivery charges or other charges, where applicable, will be disclosed during the ordering or checkout process before final confirmation.

TOWNWAY does not intend to impose undisclosed charges after a customer confirms an order.

This is particularly important for Merchant Center because Google requires the total purchasing conditions and expenses to be disclosed before purchase.

8. Product Availability

Product availability displayed on TOWNWAY is based on information available from participating sellers and inventory systems.

In exceptional circumstances, a product may become unavailable after an order is placed.

If a paid order cannot be fulfilled because the product is unavailable, the applicable amount will be refunded according to the TOWNWAY Refund Policy and the payment provider's processing timelines.

9. Orders

Placing an order represents a request to purchase the selected products.

An order may be confirmed after successful validation of the order information, product availability and, where applicable, payment.

TOWNWAY or the relevant seller may cancel an order where reasonably necessary, including cases involving:

• Product unavailability.
• Incorrect or incomplete delivery information.
• Suspected fraudulent transactions.
• Technical or pricing errors.
• Products that cannot legally be supplied.

If a prepaid order is cancelled and payment has already been successfully collected, the applicable refund will be processed according to the Refund Policy.

10. Payments

Available payment methods will be displayed during checkout.

Depending on availability, payment options may include electronic payment methods and/or Cash on Delivery.

Electronic payments may be processed securely through authorized third-party payment service providers.

TOWNWAY does not require customers to make payments outside the approved checkout or payment methods shown through the TOWNWAY platform.

11. Shipping and Delivery

Shipping and delivery conditions are governed by the TOWNWAY Shipping Policy.

Depending on the order, delivery may be fulfilled or coordinated through the seller, TOWNWAY delivery services or approved third-party logistics providers.

Estimated delivery information and applicable delivery charges will be communicated to customers where available.

Actual delivery times may vary due to location, seller processing time, carrier operations, weather, public holidays or other circumstances beyond reasonable control.

12. Cancellation, Returns and Refunds

Cancellation, return and refund eligibility is governed by the applicable:

Certain products may have different return eligibility due to their nature, hygiene requirements, perishability, safety requirements or other applicable restrictions.

Where a product is non-returnable, this should be clearly identified to the customer before purchase.

This last sentence is important. Google requires the policy displayed on product pages, the website and Merchant Center to be consistent.

13. Product Warranty

Manufacturer or seller warranties, where applicable, are subject to the warranty terms provided with the relevant product.

TOWNWAY does not independently provide a manufacturer warranty unless explicitly stated.

Customers should review the applicable warranty information displayed for the relevant product.

14. Invoices

Invoices or order documents may be provided electronically or with the delivered product, as applicable.

Seller, tax and product information appearing on an invoice will be provided in accordance with applicable requirements.

15. Customer Reviews and Content

Customers may be permitted to submit product reviews, ratings, comments, photographs or other content.

By submitting content, you confirm that:

• The content is based on your legitimate experience.
• You have the necessary rights to submit it.
• It is not unlawful, misleading, defamatory or abusive.
• It does not infringe intellectual-property or privacy rights.

TOWNWAY may moderate or remove content that violates these requirements.

Submitting content grants TOWNWAY a non-exclusive right to display and use that content in connection with its marketplace and services.

16. Intellectual Property

Unless otherwise stated, the TOWNWAY name, logo, website design and content created by TOWNWAY are owned by or licensed to TOWNWAY.

You may not reproduce, republish, sell, sublicense or commercially exploit TOWNWAY intellectual property without permission.

Third-party product names, trademarks and logos remain the property of their respective owners.

Displaying a third-party brand on TOWNWAY does not by itself imply an official partnership, authorization or endorsement.

This wording is useful because Google's Misrepresentation policy specifically warns against implying relationships or authorization with other brands that do not exist.

17. Prohibited Products and Conduct

Sellers and users must comply with applicable Indian laws and TOWNWAY marketplace requirements.

TOWNWAY may remove products or suspend accounts where products or activities are unlawful, counterfeit, fraudulent, misleading, unsafe or otherwise prohibited.

18. Third-Party Services

TOWNWAY may use third-party service providers for services such as payments, maps, communications, analytics and logistics.

Those services may also be subject to the respective provider's terms and privacy practices.

19. Links to Third-Party Websites

TOWNWAY may contain links to third-party websites.

Such links are provided for convenience and do not automatically constitute endorsement of the third-party website, company or service.

TOWNWAY is not responsible for third-party website content or practices.

20. Cookies

TOWNWAY may use cookies and similar technologies to provide website functionality, remember preferences, understand website usage and improve services.

21. Privacy

Personal information is collected and processed in accordance with the TOWNWAY Privacy Policy.

22. Service Availability

We aim to keep TOWNWAY services available and functioning reliably.

However, uninterrupted or error-free operation cannot be guaranteed.

Temporary interruptions may occur because of maintenance, technical problems, network outages, third-party services or circumstances beyond reasonable control.

23. Limitation of Liability

Nothing in these Terms excludes any rights or liabilities that cannot legally be excluded under applicable Indian law.

Subject to applicable consumer-protection laws, TOWNWAY will not be responsible for indirect or consequential loss resulting solely from circumstances reasonably beyond its control.

Nothing in these Terms is intended to restrict statutory rights available to consumers.

24. Changes to These Terms

TOWNWAY may update these Terms when required because of changes to services, business operations, regulations or legal requirements.

The latest version will be published on www.townway.in with an updated revision date.

Material changes will apply prospectively as required by applicable law.

25. Governing Law

These Terms shall be governed by the applicable laws of India.

Disputes will be handled in accordance with applicable Indian laws and the jurisdiction requirements prescribed by law.
